{"id":497,"date":"2023-07-03T06:35:39","date_gmt":"2023-07-03T06:35:39","guid":{"rendered":"http:\/\/www.tau-legal.es\/?p=497"},"modified":"2023-07-03T06:40:22","modified_gmt":"2023-07-03T06:40:22","slug":"rent-to-rent-o-subarrendamiento","status":"publish","type":"post","link":"https:\/\/www.tau-legal.es\/?p=497","title":{"rendered":"Rent-to-Rent o subarrendamiento: \u00bfqu\u00e9 es?"},"content":{"rendered":"\n<p><p>Alquilar una vivienda a un particular y subarrendar las habitaciones del inmueble a diferentes inquilinos para obtener beneficios con la operaci\u00f3n. Es una forma de inversi\u00f3n que se ha extendido estos \u00faltimos a\u00f1os por Europa: el <strong>rent-to-rent, o subarrendamiento<\/strong>. As\u00ed, los propietarios pueden maximizar el potencial de su patrimonio y obtener grandes beneficios, mientras que los inquilinos pagan menos que otras viviendas del mercado.<\/p>\n<p>&nbsp;<\/p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>En qu\u00e9 consiste el rent-to-rent<\/u><\/strong><\/h2>\n\n\n\n<p>B\u00e1sicamente, el propietario alquila la vivienda a una persona interesada (el <strong>arrendatario principal<\/strong>) que, a su vez, subalquila las habitaciones del inmueble a otros inquilinos (<strong>los arrendatarios secundarios<\/strong>). Se trata de una forma de invertir en el mercado inmobiliario y generar ingresos sin la necesidad de un elevado capital inicial para comprar una propiedad.<\/p>\n\n\n\n<p>El <strong>arrendatario principal<\/strong>, dado que ha firmado un contrato de alquiler con el propietario, es el responsable de pagar el alquiler mensualmente y de que se cumplan todas las condiciones del contrato. Tambi\u00e9n es \u00e9l quien se encarga de la selecci\u00f3n de los arrendatarios secundarios, la firma de los subcontratos de alquiler, o la resoluci\u00f3n de problemas que puedan surgir.<\/p>\n\n\n\n<p><p>Por otro lado, los <strong>arrendatarios secundarios<\/strong> son los que viven en la propiedad y pagan el alquiler al arrendatario principal. Por ello, deben cumplir las normas habituales de convivencia en una vivienda, hacer buen uso del inmueble, respetar los horarios de los vecinos, etc.<\/p>\n<p>&nbsp;<\/p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>La legislaci\u00f3n del rent-to-rent en Espa\u00f1a<\/u><\/strong><\/h2>\n\n\n\n<p>Esta pr\u00e1ctica de inversi\u00f3n en el sector inmobiliario es perfectamente legal, y est\u00e1 en auge en nuestro pa\u00eds. Las legislaciones que regulan los contratos de subarrendamiento en Espa\u00f1a son la <strong>Ley de Arrendamientos Urbanos (LAU) o el C\u00f3digo Civil de Catalu\u00f1a.<\/strong><\/p>\n\n\n\n<p>La LAU, en su art\u00edculo 8, establece que <strong>\u201cla vivienda arrendada s\u00f3lo se podr\u00e1 subarrendar de forma parcial y previo consentimiento escrito del arrendador.\u201d<\/strong> Por lo tanto, ser\u00eda ilegal el subarrendamiento de habitaciones sin el consentimiento expl\u00edcito del propietario. Tambi\u00e9n se especifican dos puntos de especial relevancia:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Duraci\u00f3n<\/strong>: el contrato de subarrendamiento no podr\u00e1 exceder la duraci\u00f3n del contrato inicial de arrendamiento. Cuando se extinga el primer contrato de arrendamiento, independientemente de los acuerdos verbales entre las partes, el segundo finalizar\u00e1 tambi\u00e9n.<\/li>\n\n\n\n<li><strong>Precio<\/strong>: el precio del arrendamiento inicial tambi\u00e9n limita el subarrendamiento, puesto que \u00e9ste no puede ser superior a la renta que paga el arrendatario principal.<\/li>\n<\/ul>\n\n\n\n<p>Por otro lado, el <strong>C\u00f3digo Civil de <\/strong>Catalu\u00f1a regula el subarrendamiento en los art\u00edculos 623-26, del Libro VI. Se establece, de nuevo, que el arrendatario no puede subarrendar la finca, excepto bajo la autorizaci\u00f3n expresa del arrendador. El art\u00edculo 623-20 dice que el subarrendamiento puede suponer la <strong>resoluci\u00f3n del contrato<\/strong> de alquiler si se hace sin el consentimiento del propietario.<\/p>\n\n\n\n<p><p>Actualmente no existe una legislaci\u00f3n que regule espec\u00edficamente el contrato de habitaciones de una vivienda. Por lo tanto, el propietario e inquilinos (y subarrendatarios secundarios) pueden elegir si subscribirse a la <strong>legislaci\u00f3n de la LAU o del C\u00f3digo Civil.<\/strong> Cada normativa puede ofrecer una seguridad y protecci\u00f3n distintas, as\u00ed como exigir unas garant\u00edas y condiciones m\u00e1s o menos estrictas.
